Bodycams geraken steeds meer ingeburgerd bij de lokale politiezones. Is dat al dan niet een goede zaak? Daar bestaan verschillende visies over.
Het gaat hierbij over een belangrijk veiligheidsgegeven en is bijgevolg een transversale aangelegenheid die betrekking heeft op de diverse overheidsniveaus.
1) Is de geachte minister voorstander van het gebruik van bodycams?
2) Beschikken alle leden van de federale politie over een bodycam? Of hoeveel? Welk percentage?
3) Heeft ze cijfers over:
a) hoeveel korpsen of politiezones er gebruik van maken? Welk percentage?
b) hoeveel politiemensen het in het totaal gaat? Welk percentage?
Is het mogelijk voor de twee hoger aangehaalde cijfers een onderverdeling te maken tussen de drie Gewesten? Graag had ik ook deze cijfers gehad gedurende de laatste vijf kalenderjaren.
4) Zijn er al analyses of studies geweest over wat de ervaringen of gevoelens zijn bij de betrokken politieagenten? Wat zijn de conclusies?
5) Vindt ze dat het al dan niet beschikken over bodycams een beleidsgegeven of belangrijk aandachtspunt zou moeten zijn bij de federale politie en de lokale politiezones? Waarom? Of waarom niet?
1) & 5) Bodycams zijn onomstotelijk een nuttig instrument voor het politioneel werk. Zowel voor de burger als voor onze politieambtenaren biedt de bodycam veel troeven. Zo kunnen we bijvoorbeeld geweld tegen politieambtenaren nooit tolereren maar ook onrechtmatige optredens van politie of rechtmatige optredens waarover klachten werden geformuleerd hebben ook baat bij de contextualisering die de beelden geven en bij het bewijsmateriaal dat deze kunnen aanleveren over de vastgestelde misdrijven en de gedane interventies. Verschillende academische studies en proefprojecten op het terrein hebben aangetoond dat het gebruik van bodycams een de-escalerend effect heeft bij een incident. Tal van zones gebruikten de bodycam reeds in een pilootfase. De ervaringen zijn positief en het draagvlak bij het personeel steeg gaandeweg doordat zij ook het nut inzagen van de objectivering van een interventie. Ik was van mening dat ondanks het feit dat men de bodycam reeds kon gebruiken onder het bestaande wettelijke kader, er toch enkele aspecten waren die opgehelderd dienden te worden. Hiertoe waren verduidelijkingen in de wet nodig. Daarnaast is het belangrijk dat iedere burger kan rekenen op een éénvormige dienstverlening en bejegening. Hiertoe heb ik, samen met de minister van Justitie duidelijke operationele richtlijnen voor lokale politiezones en de federale politie gegeven. De bodycam is echter geen verplicht instrument en maakt geen deel uit van de individuele uitrusting. Door het gebruik niet te verplichten respecteer ik de autonomie van de politiezones en de lokale overheden.

Bodycams zijn dus toestellen voor collectief gebruik en de eenheden bepalen de ratio van toekenning van bodycams voor hun diensten op het terrein. Het is dan ook logisch dat de noden per eenheid sterk kunnen verschillen.
Voor de federale politie zijn momenteel 2 225 bodycams als volgt verdeeld:
– Algemene directie bestuurlijke politie (DGA): 1 881;
– Interventiekorps (CIK): 360;
– Algemene directie van het middelenbeheer en de informatie (DGR): 14 (voor opleidingsdoeleinden).
3) In de eerste plaats wil ik het geachte lid er attent op maken dat het artikel 3 van de wet van 7 december 1998 tot organisatie van een geïntegreerde politiedienst, gestructureerd op twee niveaus voorziet dat «De politiediensten worden georganiseerd en gestructureerd op twee niveau’s: het federale niveau en het lokale niveau, die samen de geïntegreerde politiezorg verzekeren. Deze niveaus zijn autonoom en hangen van verschillende overheden af».
De gegevensbank «Management Information System» (MIS) is een politiedatabank waarin data geregistreerd worden op basis van de jaarlijkse morfologische bevragingen van alle zones van de lokale politie, waaronder de logistieke middelen waarover de politiezones beschikken.
De jaarlijkse morfologische vragenlijsten waaruit deze data voortkomen hebben als uiterste referentiedatum: 31 december 2022.
De onderstaande gegevens betreffen dus de volledige jaren 2018 tot en met 2022. De morfologische bevraging bij de politiezones over het jaar 2023 is momenteel bezig en zal resultaten opleveren later dit jaar.
De eerste tabel in bijlage bevat het aantal politiezones dat beschikt over bodycams, gegroepeerd per Gewest. Deze tabel omvat ook het percentage van aantal politiezones dat een bodycam bezit ten opzichte van het totaal aantal politiezones in het respectief gewest. In de tabel worden de cellen met de waarden van politiezones die ophielden te bestaan naar aanleiding van een fusie in het grijs aangegeven.

Opnieuw, aangezien het een collectieve uitrusting is, zal dit aantal jaarlijks variëren afhankelijk van voor welke functies de verantwoordelijke van de eenheid de bodycams inzet, met welke ratio per personeelsaantallen en op basis van de beschikbaarheid van de toestellen.
4) De Katholieke Universiteit Leuven (KUL) en de Université de Liège (ULiège) hebben een studie uitgevoerd naar bodycams in 2021:
«Uit eerder onderzoek bleek dat politieambtenaren over het algemeen positief stonden tegenover de bodycam. Politieambtenaren die bodycams gebruiken zijn zich ervan bewust dat bodycams hen kunnen beschermen, omdat het minder waarschijnlijk is dat burgers ongegronde klachten indienen als ze weten dat het incident is opgenomen.»
«Over het algemeen, zo blijkt uit eerder onderzoek, staan burgers positief tegenover het gebruik van de bodycam. Zij geloven dat het gebruik van de bodycam zal leiden tot een meer verantwoordelijke politie, tot meer vertrouwen van de burger in de politie en tot een sterkere legitimiteit van de politie.»
