Dans un tout récent rapport du 12 septembre 2018, l'organisation non gouvernementale (ONG) Transparency International classe notre pays dans la plus mauvaise catégorie avec " peu ou pas de répression " concernant les pays qui agissent contre la corruption exercée par nos entreprises à l'étranger (cf. http://files.transparency.org/content/download/2318/14294/file/2018_Report_ExportingCorruption_English.pdf).

C'est surtout la clause de " double incrimination " qui est visée. Celle-ci implique que notre pays ne peut pas engager de poursuites si l'acte de corruption n'est pas punissable dans le pays où il est accompli.

Il y a trop peu de transparence en ce qui concerne les transactions conclues. De plus, une recommandation explicite de l'Organisation de coopération et de développement économiques (OCDE) n'a pas encore été mise en œuvre. Je cite : "Belgium has not implemented the OECD WGB's recommendation "to make public, as necessary and in compliance with the relevant rules of procedure, the most important elements of settlements concluded in foreign bribery cases, in particular the main facts, the natural or legal persons sanctioned, the approved sanctions and the assets that are surrendered voluntarily"."

Est également abordé l'accroissement de l'arriéré judiciaire qui entraîne la prescription de dossiers importants: "A growing backlog of cases and shortages of judges can cause significant delays in the courts, leading to the dismissal of investigations, indefinite postponing of cases."

Transparency International avance plusieurs recommandations très claires pour améliorer la position peu enviable de notre pays en ce qui concerne la lutte contre la corruption exercée par des entreprises opérant au départ de notre pays. Il s'agit plus concrètement de :

"- extend the limitation period for foreign bribery to allow adequate time for investigations and prosecutions;

- provide a strong and harmonised legal framework for whistleblower protection in the private sector;

- remove the requirement of dual criminality for prosecution of bribery of foreign officials and trading in influence;

- publish criminal settlements in foreign bribery cases, as part of reform increasing publicity of settlements."

La politique économique est une compétence régionale mais la répression des comportements non éthiques, et en particulier la lutte contre la corruption commise à l'étranger par des entreprises belges, est une compétence fédérale. Cette question concerne dès lors une matière transversale avec les Régions.

Je souhaiterais vous poser les questions suivantes:

1) Que pensez-vous de la mauvaise place attribuée à notre pays dans le classement de Tranparency International en ce qui concerne la lutte contre la corruption commise par nos entreprises à l'étranger ?

2) À ce jour, combien de personnes ont-elles fait l'objet de poursuites pour corruption à l'étranger et pouvez-vous expliquer ce chiffre ? Combien de personnes ont-elles déjà été condamnées et pouvez-vous également expliquer ce chiffre ?

3) Êtes-vous disposé à transposer dans notre droit la recommandation de l'OCDE concernant la " clause de double incrimination " ? Pouvez-vous fournir des précisions concrètes en matière de calendrier et de contenu ? Dans la négative, pourquoi ? Que comptez-vous faire ?

4) Pouvez-vous énumérer concrètement les recommandations claires de Transparency International pour notre pays et indiquer dans quelle mesure vous les soutenez en ce qui concerne la lutte contre la corruption commise par des entreprises à l'étranger ? Dans l'affirmative comment comptez-vous les transposer en ce qui concerne :

a) la prolongation du délai de prescription ;

b) l'élaboration d'une réglementation sur les lanceurs d'alerte ;

c) la révision de la " clause de double incrimination " ; et

d) le fait de rendre publics les éléments essentiels d'éventuelles transactions pénales et fiscales en la matière ?

 

Ons land wordt door een zeer recent rapport van 12 september 2018 door de niet gouvernementele organisatie (NGO) Transparency International ondergebracht in de slechtste categorie, "little or no enforcement", wat betreft landen die optreden tegen omkoping door onze bedrijven in het buitenland (cf. http://files.transparency.org/content/download/2318/14294/file/2018_Report_ExportingCorruption_English.pdf).

Vooral de "dual criminality clause" wordt geviseerd. Dit houdt in dat ons land geen vervolging kan instellen als de desbetreffende handeling niet strafbaar is in het land waar de corrumperende handeling wordt gesteld.

Wat betreft de dadingen die worden gesloten is er te weinig transparantie. Ook werd een expliciete aanbeveling van de Organisatie voor Economische Samenwerking en Ontwikkeling (OESO) nog steeds niet geïmplementeerd. Ook wordt de oplopende gerechtelijke achterstand aangekaart die ertoe leidt dat belangrijke zaken verjaren: "A growing backlog of cases and shortages of judges can cause significant delays in the courts, leading to the dismissal of investigations, indefinite postponing of cases."

Transparency International schuift enkele zeer duidelijke aanbevelingen naar voor om de weinig benijdenswaardige positie van ons land wat betreft de strijd tegen corruptie vanwege bedrijven die opereren vanuit ons land te verbeteren. Meer concreet betreft het:

"- extend the limitation period for foreign bribery to allow adequate time for investigations and prosecutions;

- provide a strong and harmonised legal framework for whistleblower protection in the private sector;

- remove the requirement of dual criminality for prosecution of bribery of foreign officials and trading in influence;

Het economisch beleid is een gewestbevoegdheid, maar de handhaving van onethisch handelen en dan in het bijzonder de strijd tegen corruptie en omkoping in het buitenland van onze bedrijven is een federale bevoegdheid. Het betreft in deze dan ook een transversale aangelegenheid met de Gewesten.

Ik had volgende vragen voor u:

1) Hoe reageert u op de slechte plaats van ons land in de ranking van Transparency International wat betreft de strijd tegen omkoping door onze bedrijven in het buitenland?

2) Hoeveel personen werden tot op vandaag in vervolging gesteld wegens omkoping in het buitenland en kan u dit cijfer toelichten? Hoeveel personen werden reeds veroordeeld en kan u ook dit cijfer concreet toelichten?

3) Bent u bereid de aanbeveling van de OESO betreffende de "dual criminality clause" te implementeren in ons recht? Kan u concreet toelichten wat het tijdschema en de inhoud is? Zo neen, waarom niet? Wat gaat u dan wel doen?

4) Kan u de duidelijke aanbevelingen van Transparency International voor ons land concreet overlopen en meedelen in hoeverre u deze aanbevelingen steunt wat betreft de strijd tegen omkoping door bedrijven in het buitenland? Zo ja, hoe gaat u deze omzetten en dit wat betreft:

a) het verlengen van de verjaringstermijn;

b) het uitwerken van een klokkenluidersregeling;

c) de "dual criminality clause" te herzien; en

d) de belangrijkste elementen van eventuele strafrechtelijke en fiscale schikkingen hieromtrent openbaar te maken?
